An ongoing tax assessment battle between CVS Health Corp. and Monroe County in the Indiana Tax Court has both parties coming away with wins and losses, even though arguments remain the same for the different cases.
So far, the Indiana Tax Court has issued four decisions on tax assessment appeal cases regarding four different CVS stores in the county. The latest decisions, issued on Sept. 29, saw the tax court ruling in the county’s favor. This means both parties have now won two of the four cases heard in the Indiana Tax Court.
Monroe County Assessor Judy Sharp said CVS appealed all of its properties within the county. She expects the tax court to consider more cases in the future. As for the cases the court has ruled on, the results are a bit confusing, Sharp said, since the rulings were different even though neither party changed its arguments.
“It is really crazy that you can win and lose on the same bit of data,” Sharp said.
CVS Corp. petitioned the Indiana Tax Court to reverse the tax board’s determination in a case in which it appealed the 2011-2013 assessments of its Ellettsville store and its South Walnut Street location. Assessments for the Ellettsville store ranged between $1.39 million and $1.4 million, while assessments at the South Walnut Street location ranged from $2.3 million to $2.4 million.
The tax court affirmed the lower tax board’s ruling in both those cases, which had sided with the county.
On the other side, the county petitioned the tax court to reverse rulings on 2009-2013 assessments for the CVS store on North College Avenue and 2007-2013 assessments for the store located on East Third Street.
For the North College Avenue location, assessment totals were in the $3.8 million and $3.9 million range.
