SOUTH BEND — Local protections for gays and lesbians could be in jeopardy if a so-called religious freedom bill that recently cleared the state Senate also passes the House.
Absent a compelling interest, Republican-backed Senate Bill 101 would prohibit state and local governments from placing a substantial burden on the exercise of religion.
For example, the government could not force a local business to serve gays or lesbians if the owner objects on religious grounds.
That stands in conflict with South Bend’s Human Rights Ordinance, which bans discrimination in housing and employment based on sexual orientation or gender identity.
“The current draft of the bill fails to accommodate local laws, and that means that this could very probably create problems for South Bend,” including legal problems, Mayor Pete Buttigieg said.
He added that, as a matter of principle, “it’s surprising to see legislators who describe themselves as conservative be so willing to override local control.”
